    "ardena" — the brand under which we operate the Renter app, the Host app, and ardena.co.ke.

    Ardena Group Ltd is the data controller for personal data processed through the Platform under the Data Protection Act, No. 24 of 2019. Our DPO is reachable at dpo@ardena.co.ke.

  • Role

    Ardena is a peer-to-peer rental marketplace. We connect verified renters with verified hosts. We do not own, operate, or insure any vehicle. The rental contract for each booking is between the renter and the host.

03 / Regulatory framework

The principal Kenyan statutes that shape how we run the Platform. The full document for each topic explains how we comply with the relevant provisions.

  • Data Protection Act, No. 24 of 2019. Governs how we collect, process, and protect personal data, the rights of data subjects, breach notification, and cross-border transfers. Enforced by the Office of the Data Protection Commissioner.
  • Traffic Act (Cap. 403). Governs driver conduct, including the prohibition on driving under the influence and other offences that void rental cover under our Damage Waiver and most host insurance policies.
  • Insurance (Motor Vehicles Third Party Risks) Act (Cap. 405). Sets the legal minimum insurance every host must maintain on a vehicle listed on the Platform.
  • Insurance Act (Cap. 487). Regulates insurance business in Kenya. The Ardena Damage Waiver is not an insurance product and is not regulated under this Act.
  • Tax Procedures Act, 2015 and KRA requirements. Govern record-keeping and tax compliance, including the 7-year retention of transaction records and hosts' tax obligations on rental income.
  • National Transport and Safety Authority Act, 2012. Governs vehicle inspection and registration requirements relevant to hosts.
  • Companies Act, 2015. The Act under which Ardena Group Ltd is incorporated and operates as a company.
  • Consumer Protection Act, 2012. Provides general consumer-protection standards that apply to our relationship with users.
  • Step 1 — in-app support. Raise any issue first through the support flow inside the app, or by email to support@ardena.co.ke. We aim to acknowledge within 2 business days and resolve within 14 business days.
  • Step 2 — formal complaint. If the response is unsatisfactory, write to support@ardena.co.ke marked "Formal complaint", with the booking reference and the outcome you are seeking. We will route it to the responsible team and respond in writing within 10 business days.
  • Step 3 — sector escalation. Data-related complaints may be escalated to the Office of the Data Protection Commissioner at odpc.go.ke. Consumer matters may be raised with the relevant Kenyan consumer-protection authority.
  • Step 4 — mediation. Where the dispute concerns these legal documents, the parties will first attempt to resolve it through good-faith negotiation, then through mediation under the rules of the Nairobi Centre for International Arbitration (NCIA) conducted in Nairobi, in English.
  • Step 5 — court. Disputes not resolved by mediation are subject to the exclusive jurisdiction of the courts of Kenya. Nothing in this process prevents either side from seeking urgent injunctive relief from a Kenyan court.

05 / IP & brand

What is ours, what is yours, and how journalists, partners, and integrators may reference us. Full IP clauses live in the Terms.

  • Ardena marks. The "ardena" word mark, the ardena logo, and other visual identifiers are the property of Ardena Group Ltd and are protected under Kenyan and international intellectual property law.
  • Editorial / press use. You may use the ardena name in factual, editorial reporting (news articles, reviews, comparative pieces) without prior permission, provided you do not imply endorsement and you use the brand accurately.
  • Partner and integrator use of the ardena logo, screenshots, or product names requires prior written consent from Ardena Group Ltd. Logo files are available from the Brand Kit on Brandfetch.
  • User-generated content. Photos, listings, and reviews remain yours; you grant Ardena a licence to use them on the Platform as described in the Terms.
  • Infringement notices. If you believe content on the Platform infringes your rights, send a notice to support@ardena.co.ke with the URL, your relationship to the right, and a description of the alleged infringement.
  • Lawful request, lawful response. Ardena cooperates with lawful requests from Kenyan courts, the National Police Service, the Directorate of Criminal Investigations, NTSA, KRA, the ODPC, and other competent authorities, where supported by appropriate legal process (court order, summons, sealed warrant, or recognised statutory request).
  • What we disclose. We disclose only the minimum data necessary to comply with the specific request, scoped to the named individual, account, or booking. We do not provide bulk access to user data.
  • Where the law permits, we notify. Where we are not legally restricted from doing so, we will notify the affected user before disclosure to allow them to challenge the request.
  • Service of process. Formal legal correspondence may be addressed to Ardena Group Ltd at the email address below and will be acknowledged in writing. Service by other means is at the sender's risk.
  • Subpoenas and preservation requests. Send to support@ardena.co.ke with subject "Legal request — [agency] — [reference]". We aim to respond within 10 business days; urgent requests (where life or safety is at risk) are handled within 24 hours.
